Sail Dash — Terms & Conditions

These are the same terms shown and accepted inside the Sail Dash app.

1. Who we are

SailingDash ("we", "us", "our") provides the SailDash mobile application, the companion web dashboard at saildash.app, and related services (the "Service") to help Optimist and other dinghy sailors record sessions, share live telemetry with a coach, and review their performance. SailingDash is operated from New Zealand.

2. Accepting these terms

By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service. These Terms form a binding agreement between you and SailingDash.

3. Not a navigation aid

The Service is intended for training and coaching purposes only. It is NOT a marine navigation aid, safety device, or substitute for proper seamanship, lookout, charts, lifejackets, or supervision. GPS data may be inaccurate, delayed, or unavailable. Never rely on the Service for navigation, collision avoidance, or safety-critical decisions on the water. You must comply with all applicable maritime rules and the Maritime Rules (NZ) at all times.

4. Your safety and responsibility

You sail at your own risk. You are solely responsible for your own safety, for the safety of any sailor under your supervision, and for ensuring you have appropriate skill, fitness, equipment, and supervision for the conditions. You must not use the Service while operating a vessel in a way that compromises safe navigation or lookout.

5. Your account

You must provide accurate information when creating an account and keep your password confidential. You are responsible for activity that takes place under your account. If you believe your account has been compromised, contact us immediately. You must be at least 13 years old to create an account; if you are under 18, you confirm that a parent or guardian has approved your use of the Service.

6. Acceptable use

You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to interfere with or reverse engineer the Service; (c) upload content that infringes anyone's rights or is offensive, harassing, or misleading; or (d) use the Service to harvest data about other users.

7. Your data and content

When you use the Service, we process data including your email address, sail number, GPS position, speed, heading, and any notes you or your coach record. We use this data to operate the Service and let you and your coach review sessions. You retain ownership of content you submit. You grant us a non-exclusive licence to host, store, and display that content for the purpose of providing the Service to you and any coach you share a session with.

8. Sharing sessions

Sessions are private by default. If you turn on a public share link for a session, that session — including tracks, speeds, and sail numbers — becomes visible to anyone who has the link, without signing in, until sharing is turned off. If you accept an invitation to share your GPS data with a regatta, your tracks for that event appear in the regatta's race reports and are visible to its organisers and participants.

9. Privacy

We handle your personal information in accordance with the Privacy Act 2020 (NZ). In short: we collect only what we need to run the Service, we don't sell your data, and you can request access to or deletion of your data by contacting us. Data is stored on Google Firebase infrastructure and may be processed outside New Zealand. See our privacy policy for full details.

10. Service availability

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may update, suspend, or discontinue features at any time. We may also set reasonable usage limits.

11. Consumer Guarantees Act

If you are using the Service as a consumer in New Zealand, you have rights under the Consumer Guarantees Act 1993 that cannot be excluded. Nothing in these Terms limits those rights. If you are using the Service in trade, you agree that the Consumer Guarantees Act does not apply.

12. Liability

To the maximum extent permitted by law, SailingDash is not liable for any indirect, incidental, or consequential loss, or for any loss arising from your use of or inability to use the Service, including injury, property damage, or loss at sea. Our total aggregate liability to you for any claim arising out of or relating to the Service is limited to NZ$100.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your account if you breach these Terms or use the Service in a way that risks harm to others.

14. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we'll notify you in the app or by email. Continued use after changes take effect means you accept the updated Terms.

15. Governing law

These Terms are governed by New Zealand law. You and SailingDash submit to the exclusive jurisdiction of the New Zealand courts for any dispute arising from these Terms or the Service.
